Terms of use, user responsibilities, and guidelines for using Apano's aviation discovery platform

1. Introduction and Acceptance
Welcome to Apano.in ("Website", "Platform", "Portal"), owned and operated by Apano Aviation Private Limited ("Apano", "Company", "we", "us", "our"), a company incorporated under the laws of India with its registered office at The Gyan Cafe (Back Office), Devnagar Cross Road, Gota, Ahmedabad, Gujarat - 382481.
These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the Apano.in website, mobile applications, and all related services (collectively, the "Services").
By accessing, browsing, or using this Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.
Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.
2. Definitions
For the purposes of these Terms:
- "User" or "You" refers to any individual who accesses or uses the Platform, including students, aviation aspirants, and visitors.
- "Institute" or "Institution" refers to aviation training schools, colleges, flying clubs, and other educational organisations listed on the Platform.
- "Partner Institute" refers to Institutes that have entered into a commercial relationship with Apano.
- "Services" includes the discovery platform, institute listings, consultation services, information provision, and all other features offered through the Platform.
- "Content" means all text, images, graphics, logos, data, information, and other materials available on or through the Platform.
- "User Content" means any content, including reviews, comments, and feedback, submitted by Users to the Platform.
- "Apano Wings Club" or "Membership" refers to our paid lifetime membership programme for students and aviation professionals.
- "Personal Information" means any information that can be used to identify an individual, including but not limited to name, email address, phone number, and educational qualifications.
- "Third-Party Partners" includes Partner Institutes, financing companies, insurance providers, accommodation services, and other organisations with whom we may share User information.
3. Eligibility
3.1 Age Requirement
You must be at least 16 years of age to access or use this Platform. By using the Platform, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into this Agreement.
3.2 Parental Consent
If you are between 16 and 18 years of age, you represent that you have obtained consent from your parent or legal guardian to use this Platform and agree to these Terms.
3.3 Users Below Minimum Age
The Platform is not designed for or directed at individuals below 16 years of age. We do not knowingly collect Personal Information from anyone under 16. If we become aware that a User is under 16, we will take steps to delete their information and terminate their account.
3.4 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4. Account Registration
4.1 Account Creation
To access certain features of the Platform, you may be required to create a User account. When creating an account, you agree to:
- Provide truthful, accurate, and complete information
- Maintain and promptly update your account information
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorised access to your account
- Accept sole responsibility for all activities that occur under your account
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. Apano shall not be liable for any loss or damage arising from your failure to protect your account information.
4.3 One Account Policy
Each User is permitted to maintain only one account. Creating multiple accounts may result in termination of all associated accounts.
4.4 Account Verification
We reserve the right to verify User accounts through phone, email, or other means. Failure to complete verification when requested may result in restricted access or account suspension.
5. Platform Services
5.1 Nature of Services
Apano.in is a discovery and information platform that connects aviation aspirants with DGCA-approved training institutes and aviation education providers across India. Our Services include:
- Institute discovery and search functionality
- Information on courses, eligibility, fees, and admission processes
- Free consultation and guidance services
- Career guidance for aviation professionals
- Educational content and resources
- Lead generation and inquiry management
5.2 Aggregator Platform
Apano operates as an aggregator and information platform, not as an educational institution or training provider. We do not:
- Provide aviation training or education directly
- Guarantee admission to any Institute
- Accept applications or registrations on behalf of any Institute
- Make admission decisions for any Institute
- Issue any certificates, licences, or qualifications
5.3 Consultation Services
When you submit an inquiry or apply for consultation through the Platform, you are requesting assistance from the Apano team in exploring available study options. Our consultation services are provided free of charge.
5.4 No Guarantee
We do not guarantee:
- Admission to any Institute
- Availability of seats or courses
- Accuracy of fee structures (which may change)
- Employment or career outcomes
- Specific results from using our Services
6. Apano Wings Club Membership
6.1 Programme Overview
The Apano Wings Club is our premium membership programme designed to provide enhanced support to students and aviation professionals throughout their career journey.
6.2 Membership Benefits
Membership benefits may include:
- Assistance with licence registration processes
- Support with various aviation-related form filling
- Career guidance and counselling
- Priority consultation services
- Access to exclusive resources and content
- Other benefits as published on the Platform
6.3 Membership Fee and Duration
- Membership requires a one-time payment as published on the Platform at the time of purchase
- Membership is for the lifetime of the organisation, meaning it remains valid as long as Apano Aviation Private Limited continues to operate and offer the programme
- Membership fees are payable in Indian Rupees (INR) only
- Payments are processed through Razorpay and/or PhonePe payment gateways
6.4 Add-On Services
Certain services may be available as paid add-ons to the base membership. Pricing and availability of add-on services will be published on the Platform.
6.5 Non-Transferability
Membership is personal and non-transferable. It cannot be assigned, sold, gifted, or transferred to any other individual under any circumstances.
6.6 Refund Policy
- Members may request a refund within 15 (fifteen) days of purchase if not satisfied with the services
- Refund requests must be submitted in writing to [email protected] with the reason for dissatisfaction
- Refunds will be processed to the original payment method within 7-14 business days
- After 15 days from purchase, membership fees are non-refundable
- Refunds are not available if the member has utilised any significant membership benefits
6.7 Modification of Benefits
Apano reserves the right to modify, add, or remove membership benefits at any time. Significant changes will be communicated to members via email or through the Platform.
6.8 Programme Discontinuation
In the event that Apano discontinues the Apano Wings Club programme or ceases operations:
- Membership shall automatically terminate
- No refunds shall be provided for any unused portion of the membership
- Members will be notified in advance where reasonably possible
6.9 Membership Termination
Apano reserves the right to terminate membership without refund in cases of:
- Violation of these Terms
- Fraudulent activity
- Abuse of membership benefits
- Misrepresentation of information
7. Institute Listings and Disclaimers
7.1 Data Sources
Information about Institutes displayed on the Platform is sourced from:
- Publicly available information on Institute websites
- Google Business listings and Maps data
- Other publicly available online sources
- Information provided directly by Institutes
7.2 Accuracy Disclaimer
While we strive to provide accurate and up-to-date information, Apano does not guarantee the accuracy, completeness, or currency of any Institute information, including but not limited to:
- Course details and curriculum
- Fee structures and payment terms
- Admission requirements and eligibility criteria
- Faculty information
- Infrastructure and facilities
- Placement statistics
- Accreditation and approval status
Users are strongly advised to verify all information directly with the respective Institute before making any decisions.
7.3 Institute Verification
Institutes may request to:
- Verify their listing by contacting us with supporting documentation
- Update their information to ensure accuracy
- Remove their listing by submitting a written request
Institute-related requests should be directed to our Partner with Apano page or [email protected].
7.4 Institute-Provided Content
Information provided directly by Institutes on their respective pages is the sole responsibility of the Institute. Apano is not responsible for:
- Accuracy of Institute-provided information
- Claims made by Institutes
- Outcomes promised by Institutes
- Quality of services delivered by Institutes
7.5 Trademark and Copyright Notice
All Institute names, logos, trademarks, and branding displayed on the Platform are the intellectual property of their respective owners. Apano does not claim ownership of any third-party trademarks and displays them solely for identification and informational purposes. No infringement is intended.
7.6 No Endorsement
Listing of an Institute on the Platform does not constitute an endorsement, recommendation, or guarantee of quality by Apano. Users should conduct their own due diligence before engaging with any Institute.
8. User Reviews and Content
8.1 Review Eligibility
Only verified Users may submit reviews and ratings of Institutes. Verification may be based on:
- Account verification status
- Confirmed inquiry or interaction with the Institute
- Other criteria as determined by Apano
8.2 Content Moderation
All User reviews and content are subject to pre-moderation before publication. Apano reserves the right to:
- Approve, edit, or reject any User Content
- Remove previously published content that violates these Terms
- Request additional information or verification
8.3 Content Guidelines
When submitting reviews or content, you agree that your content will:
- Be truthful, accurate, and based on genuine experience
- Not contain defamatory, abusive, obscene, or offensive language
- Not infringe on any third-party intellectual property rights
- Not contain personal attacks on individuals
- Not include spam, advertisements, or promotional content
- Not contain false or misleading information
- Comply with all applicable laws
8.4 Licence Grant
By submitting any User Content to the Platform, you grant Apano a worldwide, non-exclusive, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media format and through any channels.
8.5 Ownership of User Content
You retain ownership of your User Content but are solely responsible for it. Apano does not endorse any User Content and expressly disclaims any liability arising from User Content.
8.6 Removal of Content
Apano may remove User Content at its sole discretion, including content that:
- Violates these Terms or applicable laws
- Is subject to a valid legal complaint
- Is reported and found to be inappropriate
- Is determined to be fake, fraudulent, or misleading
9. Intellectual Property
9.1 Apano's Intellectual Property
The Platform and its original content, features, and functionality are owned by Apano Aviation Private Limited and are protected by international copyright, trademark, and other intellectual property laws. This includes:
- The Apano name, logo, and branding
- Website design, layout, and user interface
- Proprietary content, articles, and guides
- Software, code, and technical infrastructure
- Databases and data compilations
9.2 Third-Party Trademarks
All third-party trademarks, service marks, logos, and trade names appearing on the Platform are the property of their respective owners. Their use on this Platform does not imply any affiliation with or endorsement by Apano.
9.3 Image Usage and Attribution
Images used on the Platform are sourced from:
- Original content created by or for Apano
- Royalty-free sources licensed for commercial use
- Freepik under Apano Aviation's valid licence agreement
- Third-party sources with appropriate permissions or under fair use
All images remain the copyright of their respective owners. If you believe any image infringes your copyright, please contact us at [email protected] with details.
9.4 Restrictions
You may not:
- Copy, modify, or distribute any Platform content without permission
- Use Apano's trademarks or branding without written consent
- Reverse engineer, decompile, or disassemble any Platform software
- Scrape, crawl, or harvest data from the Platform
- Use the Platform content for commercial purposes without authorisation
10. Data Collection and Consent
10.1 Information We Collect
By using the Platform, you consent to our collection of:

- Educational qualifications and background
- Age, date of birth, and gender
- Location and address details
- Course and Institute preferences
- Career interests and goals
Non-Personal Information:

- IP address and approximate location
- Pages visited and time spent

- Referral sources
10.2 Purpose of Data Collection

- Provide and improve our Services
- Match you with relevant Institutes and courses
- Send information about courses, admissions, and opportunities
- Provide personalised recommendations
- Process membership purchases and requests
- Respond to inquiries and provide support
- Send marketing and promotional communications

- Comply with legal obligations
10.3 Communication Consent
By registering on the Platform or submitting your information, you expressly consent to receive communications from Apano and our Partners through:

- Phone Calls — consultation calls, follow-ups, and promotional calls
- WhatsApp — messages, updates, and notifications

10.4 DND/DNC Override
By providing your contact information and agreeing to these Terms, you expressly consent to being contacted by Apano and our Partners, irrespective of your registration under:
- Do Not Disturb (DND) registry
- Do Not Call (DNC) registry
- National Customer Preference Register (NCPR)
This consent is valid for 365 days from your last interaction with the Platform and may be renewed upon subsequent interactions.
10.5 Opt-Out
You may opt out of promotional communications at any time by:
- Clicking the "unsubscribe" link in emails
- Replying "STOP" to SMS messages

- Adjusting your account preferences
Note: Opting out of promotional communications does not affect transactional or administrative communications related to your account or purchases.

- Apano is not responsible for communications from Partners
- Partner communications are governed by their respective privacy policies
- You may need to opt out separately with each Partner
11.3 Data Processing Partners

11.4 Legal Disclosure

13.2 Human Oversight
While AI may assist in content creation, all published content is reviewed and approved by our team. We strive to ensure accuracy, but AI-generated content may occasionally contain errors or inaccuracies.
13.3 Data Processing for AI
By using the Platform, you acknowledge that your interaction data (such as search queries, preferences, and usage patterns) may be processed to:

- Conduct research and analysis
Personal identifying information is anonymised or aggregated before use in AI training where appropriate.
13.4 No AI Decision-Making
Automated AI systems are not used for decisions that significantly affect Users, such as account termination or membership denial. Such decisions involve human review.

AI-generated content is provided for informational purposes only. Users should verify important information from authoritative sources and not rely solely on AI-generated content for critical decisions.
14. International Users and GDPR Compliance
14.1 International Access
The Platform is accessible to Users outside India. If you access the Platform from outside India, you do so at your own risk and are responsible for compliance with local laws.
14.2 Data Transfer
Your Personal Information may be transferred to and processed in India, where our servers are located. By using the Platform, you consent to this transfer.
14.3 Rights for EU/EEA Users (GDPR)
If you are located in the European Union or European Economic Area, you have the following rights under the General Data Protection Regulation (GDPR):

Certain Institute listings on the Platform may be marked as "Featured". Featured listings are paid placements and may receive:

15.2 Advertising Transparency
All sponsored or paid content will be clearly identified as such through labels such as "Featured", "Sponsored", or "Ad".
15.3 Affiliate Relationships
Apano may have affiliate relationships with certain Institutes or service providers. We may earn commissions or fees when Users inquire about or enrol with Partner Institutes.
15.4 Editorial Independence
Paid placements do not influence our editorial content, reviews moderation, or organic search rankings. Institute information is presented objectively regardless of commercial relationships.

Institutes and organisations interested in advertising opportunities may visit our Advertise with Apano page for more information.
16. User Conduct and Prohibited Activities
16.1 Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform:
- In any way that violates applicable laws or regulations
- To harm, abuse, harass, or threaten others
- To impersonate any person or entity
- To interfere with the proper functioning of the Platform
16.2 Prohibited Activities
The following activities are strictly prohibited:
Fraud and Misrepresentation:
- Providing false or misleading information
- Creating fake accounts or profiles
- Submitting fraudulent reviews or ratings
- Impersonating other Users or Institutes
Technical Abuse:
- Attempting to gain unauthorised access to the Platform
- Introducing viruses, malware, or harmful code
- Overloading or disrupting the Platform's infrastructure
- Scraping, crawling, or harvesting data without permission
- Circumventing security measures
Content Violations:
- Posting illegal, harmful, or offensive content
- Infringing intellectual property rights
- Spamming or posting unsolicited advertisements
- Sharing another person's Personal Information without consent
Commercial Misuse:
- Using the Platform for competing commercial purposes
- Reselling or redistributing Platform content
- Using Platform data for unauthorised marketing
16.3 Reporting Violations

17. Limitation of Liability
17.1 Disclaimer of Warranties
THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the fullest extent permitted by law, Apano disclaims all warranties, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties of non-infringement
- Warranties regarding accuracy, reliability, or completeness of content
- Warranties that the Platform will be uninterrupted, secure, or error-free
17.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APANO AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from your use or inability to use the Platform
- Damages arising from any third-party content or conduct
- Damages arising from your interactions with Institutes or Partners
- Any decisions made based on information from the Platform
17.3 Cap on Liability
In no event shall Apano's total liability to you exceed the greater of:
- The amount paid by you to Apano in the twelve (12) months preceding the claim, or
- One Thousand Indian Rupees (INR 1,000)
17.4 Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
17.5 Third-Party Services
Apano is not responsible for:
- Actions, omissions, or quality of services provided by Institutes
- Content or practices of third-party websites linked from the Platform
- Products or services offered by our Partners
- Any transactions between you and third parties
18. Indemnification
18.1 Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless Apano Aviation Private Limited, its directors, officers, employees, agents, affiliates, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use or misuse of the Platform
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your User Content
- Your infringement of any third-party rights
- Any dispute between you and any Institute or third party
- Any false or misleading information provided by you
18.2 Cooperation
You agree to cooperate fully with Apano in the defence of any claim. Apano reserves the right to assume exclusive defence and control of any matter subject to indemnification by you.
19. Dispute Resolution
19.1 Informal Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Platform, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days.
19.2 Mandatory Arbitration
If the dispute cannot be resolved informally, you and Apano agree to submit the dispute to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.
Arbitration Terms:
- The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties
- If parties cannot agree on an arbitrator within 15 days, the arbitrator shall be appointed as per the Act
- The seat of arbitration shall be Gandhinagar, Gujarat, India
- The language of arbitration shall be English
- The arbitrator's decision shall be final and binding
- Judgment on the award may be entered in any court of competent jurisdiction
19.3 Exceptions to Arbitration
Notwithstanding the above, either party may:
- Seek injunctive or equitable relief in a court of competent jurisdiction
- Pursue claims in small claims court if eligible
19.4 Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as a class action or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
19.5 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
19.6 Jurisdiction
Subject to the arbitration provisions above, the courts of Gujarat, India shall have exclusive jurisdiction over any disputes arising from these Terms.
20. Account Termination
20.1 Termination by You
You may terminate your account at any time by:

- Using the account deletion feature (if available)
Upon termination, your access to the Platform will cease, but certain provisions of these Terms will survive.
20.2 Termination by Apano
Apano reserves the right to suspend or terminate your account, without prior notice, for reasons including but not limited to:
- Fraud: Any fraudulent activity or misrepresentation
- Abuse: Harassment, abuse, or threatening behaviour towards other Users, Institutes, or Apano staff
- Terms Violation: Violation of these Terms or any applicable policies
- Illegal Activity: Engagement in any illegal or prohibited activities
- Inactivity: Extended periods of account inactivity (typically 3+ years)
- Platform Integrity: Actions that harm the Platform or its Users
20.3 Effects of Termination
Upon termination:
- Your right to use the Platform immediately ceases
- Your account and associated data may be deleted (subject to data retention requirements)
- Any unused membership benefits are forfeited without refund
- Provisions relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive
20.4 Appeals
